LABOUR COMISSIONER ORDERS WORK PERMITS’ SCRUTINY WITHIN 30 DAYS FOR ALL NON-CITIZENS IN TANZANIA.

Breakthrough Attorneys is aware that on Wednesday, 22nd February 2017, through the Guardian, the Commissioner for Labour has issued a public notice requiring all foreigners working in Tanzania to submit their work permits to the nearest labour office for verification.
The Commissioner has stated that it has come to the knowledge of the Government that some employers and/or their agents are employing or engaging foreigners either by knowing or not knowing contrary to the provisions of Non-Citizens (Employment Regulations) Act, 2015. The Commissioner has cautioned local companies in Tanzania to refrain from hiring foreigners without requisite permits and documentation.
Legal Analysis of the Notice:
The requirement to obtain work permit for non-Tanzanians working in the country is provided for under Regulation 9 (1) and (2) of the Non-Citizens (Employment Regulations) Act, 2015. On default, the victim shall be liable for payment of a fine of not less than Ten Million Shillings or imprisonment for a term not less than two years or both.
Required Action:

This should be done by ensuring that all employers and foreigners submit their work permits to the nearest labour office within the grace period provided for verification.
